What this is

A motion that asks the appellate court to pause enforcement of the trial court's order while your appeal is pending. Without a stay, the order stays in effect throughout the entire appeals process - which can take 12 to 18 months. If the order is causing real harm to your case or children during that time, the stay is your remedy.

Stays are not granted automatically. The motion has to show both that you are likely to succeed on appeal and that the order is causing irreparable harm. We draft both arguments to Washington appellate standards.

Why this matters for your case
Most parents who appeal assume filing the notice pauses the order. It does not. Without a successful stay motion, your appeal can take 18 months while the harmful order remains in full effect.
